While both the EU and the UK currently provide “visa free travel” for short term visits, the deal allows this to change in the future. In any event, short term business trips are now subject to local immigration rules.
What do we say
More planning will be needed for cross-border business travel. While EU nationals do not currently need to apply for a visa if they are visiting the UK on a short business trip (for no longer than six months), there are restrictions on the business activities they can undertake and border officials can refuse entry if business travellers do not meet the “genuine visitor” test.
There are similar restrictions on UK business travellers visiting the EU – including specified permitted activities and stringent requirements in respect of the number of days which can be spent in the Schengen area without a visa.
What can you do? Plan in advance of travel.
- Ensure that business travellers are only undertaking permitted activities and do not overstay the visa free limits.
- Equip business travellers with evidence of the purpose of their visit to present to border officials.
