Russell is a Partner and Head of Consumer & Motor Finance. With over two decades of experience in the retail finance sector, he is a recognised expert in contentious and non-contentious financial services matters with particular expertise in consumer credit, motor finance, mortgage lending and asset finance. Russell advises a broad spectrum of clients, including high street banks, building societies, motor, consumer, mortgage and asset finance providers, credit card companies, payment services providers, point-of-sale lenders, debt purchasers, and fintech disruptors entering the market.

Known for his ability to simplify complex legal issues, Russell is a trusted advisor to boards and senior management teams navigating regulatory and commercial challenges. His collaborative approach and deep sector knowledge have helped clients resolve highly technical issues and implement compliant, commercially sound strategies.

Russell has a strong and long-standing relationship with the Finance and Leasing Association and the Consumer Credit Trade Association. For many years, he has delivered training or presented at seminars and conference for each of them.  He plays a key role in industry lobbying, and recently was part of HM Treasury’s expert working group on consumer credit reform.  Russell is the author of many industry-standard textbooks and looseleafs (for more, see ‘Awards’ below).

Experience

Advising a significant part of the industry on their approach to motor commissions, acting for Close Brothers in both the Court of Appeal and the Supreme Court in Hopcraft, and advising a number of lenders on their engagement with the Financial Conduct Authority and the Financial Ombudsman Service, and on their approaches to provisioning and the proposals for a consumer redress scheme.

Advising a number of consumer, motor and asset finance providers on post-contractual documentation compliance (including notices of sums in arrears, periodic statements, notices of default sums, default, enforcement and termination notices, settlement statements) and advising on significant remediation projections.

Advising firms on their documentation, policies and procedures in light of regulatory change (including ongoing compliance with the consumer duty).

Advising firms, and drafting, clear and plain English documentation on a number of innovative products (including buy-now pay-later products, high cost products, motor finance, credit cards, high-cost short-term credit, overdrafts, credit cards, mortgage products (including regulated mortgages, consumer buy-to-let, buy-to-let and bridging) and other innovative consumer lending products (both secured and unsecured)).

Advising funders looking to invest into consumer, motor and asset finance providers (including advising on unenforceability risks and regulatory issues for such firms to consider).

Providing training to the industry on (a) the Consumer Credit Sourcebook, (b) consumer law for motor finance providers, (c) consumer credit issues in litigation, (d) distance selling of financial services, (e) financial promotions for both consumer credit and mortgages, (f) an introduction to regulated lending and (g) repsonsible lending issues for both credit and mortgages.

Reviewing consumer lending documentation for fairness under the Consumer Rights Act 2015, for penalty clauses and under the unfair relationship provisions.
