Data Protection and Freedom of Information
We offer clients a full range of data protection legal advice including advice on the General Data Protection Regulation (GDPR), freedom of information, cybersecurity and privacy legal advice on contentious and non-contentious matters.
We have strength in depth, with a team that has experience of the City, regulators, prosecutors, private practice and in-house lawyers. We are therefore unusually positioned in being able to give well-rounded, commercial and practical risk-based advice, delivered in a straightforward and client-friendly manner.
We regularly provide legal advice to clients regarding the development of industry specific, tailored data protection policies and procedures, data sharing agreements, including the collection and transfer of data between entities and jurisdictions, with a view to minimising the risk of breaches and enforcement action by the Information Commissioner’s Office (ICO). We frequently intercede with the ICO on behalf of clients and have advised on data security breaches as well as responding to sensitive data subject access requests.
We are also at the forefront of the recent developments in the data protection landscape, particularly the implementation of the GDPR and the EU-US Privacy Shield, which has resulted in several invitations to speak at industry seminars and conferences, both in the UK and the US, as well as being commissioned to write articles for external publications as recognised experts in these areas.
Our experience includes:
- advising an NHS Authority on a freedom of information appeal before the First Tier Tribunal (Information Rights)
- advising on responding to requests under the Freedom of Information Act 2000 and the Data Protection Act 1998
- advising public and private organisations on the implementation of processes and procedures to comply with the Freedom of Information Act 2000 and the Environmental Information and Regulations 2004
- advising on data protection issues in relation to third party claims data, anti fraud issues and website policies.
