Adjudication

We know that today’s construction industry is being squeezed by an increasing number of issues. Whether that’s the ongoing impact of COVID and Brexit, or the high cost of materials and global supply chain delays – these factors, especially when combined, mean that cash flow difficulties sadly continue to be all too common.

Adjudication can be a quick and effective tool for unlocking payment disputes and encouraging money to flow down the supply chain again.

The Housing Grants Construction and Regeneration Act 1996 (as amended) created a statutory right to refer a dispute arising under a construction contract to adjudication.  If the unsuccessful party refuses to comply with the Adjudicator’s decision, the successful party can then apply to the court to obtain a court order validating that decision – a process called adjudication enforcement.

How we can help

Our team of specialist lawyers have many years of experience in adjudication and we provide straight forward no-nonsense strategic advice that helps our clients to start, defend or avoid the adjudication process in a cost-effective way. Whether you are experienced in adjudication or have never come across this process before, our expert team are on hand to guide you every step of the way.

We also have extensive experience bringing and defending adjudication enforcement proceedings in the Courts and our team has been part of several key reported judgments.

This familiarity with the adjudication process means we’re used to its speed and our team has the strength and depth to enable us to prepare adjudication submissions within the necessary tight timescales.

Our selection of transparent pricing models also means that you’ll have full visibility of the cost implications from the outset, with no unpleasant surprises.

Our clients

Our adjudication work covers all elements of the supply chain, so we have a well-rounded understanding of the typical tactics of each party. This experience also has the added benefit of  helping us to anticipate and predict what could happen next and advise our clients accordingly.

Our clients include developers, local authorities, main contractors, sub-contractors and consultants who all need help in resolving payment disputes.
