In its approach to Asia, Walker Morris has maintained the same strategy as it has done for other foreign markets in that we do not open up offices overseas but instead we focus on developing close working relationships with respected domestic law firms.
Asia is an obvious market for Walker Morris to explore because we have personnel with experience of living and working in Hong Kong and China and well over a decade’s experience of advising UK companies on investing in China, for example, as far back as 1992 we assisted in the establishment of a Chinese joint manufacturing venture.
The emergence of dynamic general and specialist law firms with whom Walker Morris has had long standing contacts has led to us acting for a growing number of leading Asian companies such as Haier and aigo. On behalf of aigo, Walker Morris won the first trade mark infringement claim brought by a Chinese company before the High Court in the UK.
Using our international project management experience we have supported many global organisations including Jemella/ghd in managing its international brand and developing its worldwide anti-infringement programme. This included obtaining a successful freezing order through the Hong Kong Courts against defendants based in the People’s Republic of China.
“The ‘technically proficient’ and ‘strategic’ practice has significant ‘depth of knowledge’ in trade mark infringement and patent litigation” – Legal 500
Our approach to working with UK companies wishing to set up in Asia is to act as the principal interface for the client. Our aim is to exceed your expectations and most importantly to provide a seamless and integrated service through law firms with which we have worked closely in the past. We offer commercial awareness and experience of working in Asia in a practical context, particularly how to avoid common pitfalls on the ground.
Because we are not constrained by having offices in Asia, we are able to effectively “cut out the middleman”. We can identify at least two firms whom we can recommend, from our own experiences and those of our clients, to have the highest quality and breadth of commercial offering, expertise and deliverability to ensure they meet client needs. If required, we can obtain references from clients to whom we have recommended and who have used such firms. The recommended firms are competitive on price and aware of the importance of providing certainty on cost including fees.
