According to The Times [1], claims management company We Fight Any Claim has threatened to seek a judicial review of the FCA’s consultation over a two year cut-off for all PPI claims and in relation to the FCA’s proposals that firms be allowed to retain a portion of their undisclosed commissions charged on PPI policies.

The Times has reported that the claims management company has obtained a legal opinion which asserts that the FCA’s proposals are probably unlawful on the basis that its plan to raise public awareness of the two year claim deadline is inadequate and that its proposals generally fail to protect consumers.

The consultation is due to conclude tomorrow, 26 February 2016.  Walker Morris will continue to monitor and report on developments.
