New mandatory state aid complaint form

The European Commission recently introduced a new form which must be used by anyone wishing to complain about a potential illegal state aid.  This is part of the State Aid Modernisation programme aimed at streamlining procedures.

The form comes out of the revised Procedural Regulation (see Links above for our earlier article on this, Major Move Forward for the State Aid Regime) which introduced a requirement for complainants to provide certain key information.  The new form will enable a complainant to submit this information in a complete and structured manner and should reduce the administrative burden on the Commission now that they have a duty to investigate all complaints.

Only ‘interested parties’ can complain.  These are member states and any person, undertaking or association of undertakings whose interests might be affected by alleged illegal aid.
