Parental bereavement rights to become law from 2020

Payslip Print publication

From 2020, bereaved parents will have the right to at least 2 weeks’ paid bereavement leave. The right will apply where parents have lost a child below age 18 and will include a stillbirth after 24 weeks.

The statutory pay will be based on the higher of a prescribed rate or 90% of average earnings and employees will be protected from detriment or dismissal for taking bereavement leave. Of course, many employers will already have policies or practices in place to give support to bereaved employees so this change to the law will reflect existing good practices already followed. The new right is expected to come into force during 2020.
