Will they stay or will they go? Employment Tribunal fees

The government has announced that it is considering the options for a review of the impact of employment tribunal fees. The review of the fee system that had been announced in mid-2014 by the previous government has not been pursued.

In the meantime, UNISON’s ongoing Judicial Review case challenging the lawfulness of fees has now been heard by the Court of Appeal. The outcome of the appeal is very difficult to predict. Much will depend on how the Court views the new evidence that UNISON will produce dealing with its assertion that fees are a barrier to justice for certain groups of people. We will publish an update as soon as the decision is announced.
