David Kilduff

Partner - Head of Commercial Group

David is a nationally recognised leader in the field of public sector commercial law, including experience in all aspects of funding, powers, procurement, joint ventures and service delivery mechanisms in the local government, health, education and defence sectors. He has undertaken leading edge work in a full range of public and private funded infrastructure projects including a number of major redevelopment schemes.

David chairs of Walker Morris' Waste, Energy and Renewables Group, a multi-disciplinary team of sector specialists able to advise upon a full range of legal issues but with a particular emphasis on the delivery of essential infrastructure. He advises clients on a full range of range of issues in the sect from project inception through procurement and delivery. With over 15 years experience David has advised corporate and public sector clients on waste disposal, waste to energy and, more recently, projects associated with climate change and renewables projects such as biomass, Anaerobic Digestion and RdF/SRF offtake facilities and cross border transfer of waste resources. Downstream this includes heat/power off-take contracts, fuel-use agreements, fly-ash processing and similar contracts.

Davihas extensive experience in advising Regional Development Agencies, local authorities and URCs on regeneration work and the distribution, receipt and use of grant funding. He regularly advises on vires, procurement and state aid rules as well as general governance issues drawing upon a background of work in the sector spanning 25 years. He has also advised External Auditors on tender processes, vires and general governance matters.

David leads our Public Sector team and was referred to in Chambers 2006 as “high-caliber” and “the name that automatically springs to mind for local government work” .

In Chambers 2007 it continues stating that David's “exceptional negotiating skills and affable manner” have proved a hit with clients, who also commended his “wonderful sense of humour” and calm demeanour.
